Terms of Service

1. Introduction

These Terms of Service (the “Terms”) govern your access to and use of the 8 Visions website, game server, forums, and any related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. No Affiliation With Jagex

8 Visions is an independent fan-made project and is not endorsed by, affiliated with, or sponsored by Jagex Ltd. “RuneScape” and related intellectual property are trademarks or registered trademarks of Jagex Ltd. All such rights remain the exclusive property of their respective owners.

Nothing in these Terms shall be construed as granting you or 8 Visions any rights in any third-party intellectual property, including but not limited to that of Jagex Ltd.

3. Eligibility

By using the Service, you represent and warrant that:

  • You are at least 13 years of age, or older if required by applicable law in your jurisdiction;
  • If you are under the age of majority in your jurisdiction, you have obtained consent from a parent or legal guardian to use the Service;
  • You are not prohibited from using the Service under applicable law;
  • You will comply with these Terms and all applicable laws and regulations.

4. Accounts

To access certain aspects of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality and security of your login credentials and for all activity that occurs under your account.

You agree to:

  • Provide accurate, current, and complete account information;
  • Promptly update your information as needed;
  • Notify us immediately of any unauthorized use of your account or other security breach;
  • Not share your account credentials with others.

We reserve the right, in our sole discretion, to refuse registration, suspend, or terminate any account for any reason, including but not limited to violation of these Terms.

5. Rules of Conduct

You agree that you will not, directly or indirectly, engage in any of the following while using the Service:

  • Harassment, hate speech, threats, or abusive behavior toward other users or staff;
  • Cheating, botting, macroing, exploiting bugs, or using unauthorized third-party programs;
  • Real-world trading (“RWT”) of accounts, items, currency, or services for real money or equivalents;
  • Advertising or promoting other private servers or unrelated products/services without permission;
  • Impersonating staff, other players, or any third party;
  • Uploading, sharing, or distributing content that is illegal, infringing, or harmful;
  • Attempting to interfere with, damage, or disrupt the Service or its infrastructure (including DDoS, hacking, or reverse engineering);
  • Engaging in any activity that violates applicable law.

Violation of these rules may result in warnings, temporary suspensions, permanent bans, deletion of accounts, or other appropriate actions at our discretion.

6. Virtual Items and Game Progress

The Service may provide virtual items, currency, experience, and other forms of in-game progress (collectively, “Virtual Items”). All Virtual Items are part of the Service and have no real-world cash value. You do not own any Virtual Items; instead, you are granted a limited, revocable, non-transferable license to use them within the Service.

We may modify, rebalance, limit, or remove Virtual Items at any time, with or without notice. We are not responsible for any perceived or actual loss of value, items, or progress, including loss due to bugs, rollbacks, account actions, or server issues.

7. Donations and Purchases

The Service may offer optional donation packages or purchases that support server costs and development. By making a donation or purchase, you acknowledge and agree that:

  • All donations and purchases are considered final and non-refundable, to the fullest extent permitted by law;
  • No goods or services of real-world monetary value are being sold;
  • Any in-game benefits granted as a result of a donation or purchase are Virtual Items and may be modified or removed as described in Section 6;
  • Chargebacks or payment disputes may result in suspension or termination of your account.

8. Intellectual Property

All content and materials provided as part of the Service (excluding third-party intellectual property), including but not limited to custom code, artwork, designs, logos (other than third-party marks), and text, are owned by or licensed to 8 Visions and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the Service or any content contained therein, except as expressly authorized in writing by us.

9. Third-Party Rights and Requests

We respect the intellectual property and legal rights of others. If a rights holder or relevant third party (including Jagex Ltd.) requests that we remove content or take action regarding the Service, we may comply with such request, including suspending or shutting down the Service or portions of it, at our sole discretion.

Nothing in these Terms limits the rights of any third-party rights holder or prevents them from enforcing their own terms, rights, or policies.

10. Service Availability

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or secure access to the Service. The Service may be temporarily or permanently modified, suspended, or discontinued at any time, with or without notice.

11. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Service will be secure, error-free, or that any defects or issues will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, in no event shall 8 Visions, its owners, staff, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to the Service shall not exceed the amount (if any) you have paid to us in the 6 months immediately preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless 8 Visions, its owners, staff, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with:

  • Your access to or use of the Service;
  • Your violation of these Terms;
  • Your violation of any third-party right, including any intellectual property or privacy rights.

14. Termination

We reserve the right, in our sole discretion and without prior notice, to suspend or terminate your access to the Service (including deletion or restriction of your account) for any reason, including but not limited to:

  • Breach of these Terms or our rules of conduct;
  • Suspicion of fraudulent, abusive, or illegal activity;
  • Compliance with legal obligations or third-party requests.

Upon termination, your right to access or use the Service will immediately cease. Sections of these Terms which by their nature should survive termination shall survive (including, without limitation, ownership, disclaimers, limitations of liability, and indemnification).

15. Changes to These Terms

We may update or modify these Terms from time to time. When we do so, we will update the “Last updated” date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

If you do not agree with the revised Terms, you must stop using the Service.

16. Governing Law

These Terms and any disputes arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the jurisdiction determined by the server operator, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of that jurisdiction (unless otherwise required by law), and you consent to the personal jurisdiction of such courts.
